Terms and Conditions
1. The Juice Up with Tropicana (“Contest”) is brought to you by PepsiCo (Malaysia) Sdn. Bhd (“Organizer”).
2. Contest is open to all Malaysian citizens residing in Malaysia
except the employees and family members of the Organizer, its associate
companies, bottlers, its advertising and promotional agencies and their
associate companies (“Users”).
3. Contest is valid from 00:00 hours on August 1, 2015 to 11:59 pm on
August 31, 2015 (“Contest Period”), both dates inclusive. Entries
received after the Contest Period will not be eligible and will be
discarded.
4. To participate in the Contest, the User has to like ‘Tropicana Malaysia’ fanpage on Facebook.
5. Users will have to grant permission to the application to play the Contest.
6. There is no entry fee and no purchase necessary to enter this Contest.
7. In order to participate User will have to upload an original photo of a present moment of them enjoying real life.
8. Users can participate in the Contest as many times as possible
during the duration of the Contest to improve chances of winning.
9. 4 (four) weekly winners will get a Tropicana Gift Pack worth RM
200 (Malaysian Ringgit Two Hundred) to be collected from Bonsey Design
Sdn Bhd at the address B5-2, Centrio Pantai Hillpark, Jalan Pantai
Murni, 59200 Kuala Lumpur
10. One Grand Prize winner will win a beach getaway voucher worth RM
3000 (Malaysian Ringgit Three Thousand) to be claimed by the winner from
Orient Escape Travel Sdn Bhd to be collected from the adress 17A-2,
Jalan 14/20, Section 14, 46100 Petaling Jaya
11. The winners will be selected basis the following criteria (‘Judging Criteria’):
- (i) 60% weightage will be given to the marks given by independent panel of judges basis creativity and inspiring photo
- (ii) 40% weightage will be given to the amount of likes each photo receives via the voting mechanism on Facebook.
12. Basis the above Judging Criteria the Grand Prize Winner will be
declared after the last date of Contest Period within 14 days of the
Contest closure. The weekly prize winners will be announced within 3
days of the start of the following week.
13. The prizes will have to be collected by the winners at the address as mentioned above.
14. Redemption of the Grand Prize is also subject to the terms and
conditions as imposed by Orient Escape Travel Sdn Bhd. Organizer is not
liable or responsible in any respect for breach of contract, any action
or inaction, commission or omission whether intentional, negligent or
otherwise, on the part of such third party suppliers resulting in any
loss, damage, delay or injury to you or your travel companions. Vacation
itineraries, including changes after the redemption which may include
missed ports of call, are the sole responsibility of the supplier.
Furthermore, Organizer assumes no responsibility for overbooking,
cancellation or delays by hotels, airlines, cruise lines, tour operators
or ground transportation or other providers of service.
15. Organizer is not responsible for any potential risks and hazards
associated with travel. It is the responsibility of the recipient to
verify accuracy of all reservation information contained on the
confirmation. Names provided to Orient Escape Travel Sdn Bhd must match
legal names as they appear on your passport or government issued photo
ID. Orient Escape Travel Sdn Bhd must be notified immediately if any
changes are necessary.
16. The winner will be contacted by the representatives of the
Organizer on the contact number shared at the time of registration on
Facebook. The winner would be contacted thrice over a period of 48 hrs.
In case the winner is not reachable or the Prize cannot be redeemed by
him for any reason whatsoever, the Organizer will reserve the right to
pass on the Grand Prize to another participant without any further
notice to the winner.
17. The prizes will have to be redeemed by the winners within 30 days
from the date of announcement failing which the prize will be
forfeited.
18. One participant can win only one prize during the Contest Period.
19. The winner will be required to furnish the complete name, address
and phone number and such other information/details as may be asked by
the representatives of the Organizer.
20. The participants shall ensure that the uploaded picture is true
and genuine and is not obscene, threatening, harassing, libelous,
deceptive, fraudulent and invasive of another's privacy, offensive,
defamatory of any person or otherwise illegal. Participant warrant that
the content he/she submit on Facebook does not infringe any patent,
trademark, trade secret, copyright, or other intellectual or proprietary
or privacy right of any party or individual.
21. The Organizers will not be liable for any loss of data due to
server issues and other technical faults that may come up in the real
time monitoring of the Facebook updates sent out by users during the
Contest Period
22. The Organizers or their representatives will contact the winner
at the contact number given by him and verify the claim before redeeming
the prize. Award of prizes is subject to the verification by the
Organizer. After verification the winner will be informed of the entire
process of redemption of the prize.
23. The pictures of prizes depicted on the press ads/posters/
TVC’s/social media etc. are only representative and the actual prizes
may vary from the depictions.
24. Decision of Organizer’s will be final and binding with regard to
Contest and prizes and no correspondence will be entertained in this
regard. Should there be any disputes relating to this Contest, they
shall be subject to the jurisdiction of courts at Kuala Lumpur only.
25. The prizes are personal to the winners and are not transferrable and cannot be sold under any circumstances.
26. By uploading the picture (a) the participant grants to the
Organizer a perpetual, non-exclusive, worldwide, royalty-free license to
use, copy, print, display, reproduce, modify, publish, post, transmit
and distribute the photograph and (b) Participant certify that the
photograph used (or, if a minor, his/her parent/legal guardian)
authorizes the Organizer to use, copy, print, display, reproduce,
modify, publish, post, transmit and distribute the photograph and any
material included in such photograph; and (c) Participant agree to
indemnify the Organizer and its affiliates, directors, officers and
employees and hold them harmless from any and all claims and expenses,
including attorneys' fees, arising from the photograph and/or your
failure to comply with these the terms described in this document.
27. At the Organizer's request, winners must participate in all
promotional activity (such as publicity and photography) surrounding the
winning of the prize, free of charge, and they consent to the Organizer
using their name, likeness, image and/or voice in the event they are a
winner (including photograph, film and/or recording of the same) in
promotional material or in any media for an unlimited period without
remuneration for the purpose of promoting this Contest (including any
outcome), and promoting any products manufactured, distributed and/or
supplied by the Organizer.
28. No cash payment will be made in lieu of the prize.
29. The Organizer reserves the right to change/modify/or withdraw the
Contest without any prior notice of the same at its sole discretion.
The Organizer reserves the right to modify the terms and conditions
without any prior notice.
30. Organizers shall not be responsible for any loss, injury or any
other liability arising out of the Contest or due to participation by
any person in the Contest.
31. Organizer shall not be liable for any loss or damage due to Act
of God, Governmental actions, other force majeure circumstances and
shall not be liable to pay any amount as compensation or otherwise for
any such loss.
32. The Organizers accepts no responsibility for any tax implications
that may arise from the prize winnings. Winners will have to bear
incidental costs, if any, that may arise for redemption of the prize.
33. This Contest is in no way sponsored, endorsed or administered by or associated with Facebook.
